Newark Can Destroy Seized ATVs, Dirt Bikes Under New Ordinance
NEWARK, NJ — “Property that has been forfeited shall be destroyed.” This may the fate of your ATV or dirt bike if it’s seized by the police in Newark under a new local law passed last week.
The Newark City Council voted to approve Ordinance 23-0609 on second reading at their May 24 public meeting, clearing the way for some new rules when it comes to the ubiquitous vehicles. Read the full legislation at the bottom of this article.
According to Newark’s ordinance, it aims to “minimize the detrimental effects of illegally operated ATVs and off-road vehicles within the city and to further protect the public peace and good order.”
State law already bans ATVs and dirt bikes from public roads. But towns and cities are able to roll out additional regulations within their borders.
Under Newark’s new rules, any ATV or dirt bike that has been forfeited will be destroyed if it “can serve no lawful purpose, or if it presents a danger to the public health, safety or welfare.” Police will be able to seize the vehicles under several conditions, including if the identity of its owner is unknown, or if the vehicle was involved in an accident that causes serious injury or death.
In addition, the law bans gas stations or their employees from dispensing gasoline to ATVs and dirt bikes unless they’re transported to the pumps on a registered truck or trailer.
